General conditions of sale for private customers

FIELD

The general conditions of sale contained in this document govern the contractual relations between the company KDC NUTRITION SUISSE and its customer within the framework of a distance selling system. Both parties accept them without reservation. These conditions will prevail over all other conditions. This contract is subject to Swiss law.

PRODUCT INFORMATION AND APPLICABLE LEGISLATION

In accordance with article L. 111-1 of the Consumer Code, the company KDC NUTRITION SUISSE presents on its site the products for sale with their main characteristics.

The choice and the purchase of a product are placed under the sole responsibility of the purchaser.

PRICE

The prices indicated in Swiss francs are inclusive of all taxes (2.5% VAT for dietary supplements and 7.7% for accessories, materials and postage).

The prices are modifiable at any time without notice within the framework of the regulations in force, knowing that the articles will be invoiced on the basis in force at the recording of the order.

All orders are invoiced in Swiss francs and payable in Swiss francs.

DELIVERY TERMS - DEADLINES

Once payment has been made and accepted, orders are generally shipped within 24 working days.

Colissimo delivery costs are calculated automatically according to the weight of the products for customers domiciled in Switzerland. For customers domiciled outside Switzerland, delivery costs are calculated based on the weight of the package and the customer's address.

WARNINGS

The information provided on this site is for informational purposes only. Information on each product is taken from the manufacturers, on advertising brochures or on the labels of the products themselves. We cannot be held responsible for typographical errors or changes in product wording.

None of the substances used in these products have been approved to diagnose, treat or prevent any disease.

General sales conditions for professional customers

Article 1: Scope

These general conditions of online sale (hereinafter "GTC") are concluded between:

- on the one hand the company KDC NUTRITION - Gym Riviera SNC, registered in the VD trade register of Noville under number CHE-453-709-636

- on the other hand, any natural or legal person governed by public or private law or any reseller making an online purchase on the KDC NUTRITION website, namely www.kdcnutrition.ch (hereinafter the "CUSTOMER")

Any order placed by the CLIENT on the kdcnutrition.ch website (hereinafter the "Site") implies the prior, express and unreserved acceptance of the GTC by the latter, to the exclusion of any other document in contradiction with these CGV.

The GTC can be modified at any time by the company. The GTCs applicable to any order placed on the site will be those in force on the day of the order.

The titles of the articles of the GTC are given for information only. They will therefore be declared non-existent in the event of a problem with the interpretation of the titles or GTC clauses.

If one of the stipulations of these General Conditions were deemed invalid by the competent court, it will be expressly withdrawn. However, this deletion will not affect the validity of the other provisions of the GTC.

Article 2: Offer

2.2 The photographs illustrating the products on the site, in support of the text, do not enter into the contractual field.

2.3 The company offers its CUSTOMERS to benefit from discounts on their orders according to their purchase amounts. The reductions are not cumulative.

Article 3: Order

3.1 The customer places his orders directly on the site. Orders on plain paper or by email are not accepted by the company.

3.2 To place an order, the customer must contact the company to open a customer account. When the opening of the customer account is validated by the company, a unique account is created for the customer. The company sends him his personal identifiers.

The defect or insufficiency of the information provided by the customer prevents the validation of the creation of a customer account. The customer must also be able to provide a Kbis extract (for pro orders) in connection with the sale of food supplements.

3.3 Any order placed implies acceptance of the prices and descriptions of the products. Any order can only be considered final when full and effective payment of the sums due. Orders validated with the company are irrevocable for the customer, unless accepted in writing by the company.

Written order confirmation will be sent to the customer by email with an order number.

The confirmation of the order as well as all the data recorded by the company constitutes proof of the transactions. The company reserves the right to cancel any order from a customer with whom it has had a dispute concerning the payment of a previous order or any order presenting abnormal conditions and / or which does not respect the terms of the GTC.

3.4 Stock-outs or awaiting replenishment are indicated on the product sheet presented on the site. The customer will not be able to select the product concerned (in the packaging and the perfume unavailable) and add it to his order.

In the event of a temporary and exceptional out of stock not indicated on a product, the company undertakes to notify the customer by e-mail or by telephone within 48 hours to 72 hours to offer a replacement product equivalent to its fresh.

In the absence of a response from the customer, the order validated on the site by the customer containing one or more products out of stock will be delivered without the unavailable products. KDC NUTRITION will reimburse products out of stock within fourteen (14) days in accordance with the GTC.

Article 4: Price

4.1 The price of each product indicated on the site is expressed in Swiss Francs excluding taxes.

The prices do not include the shipping costs which are calculated automatically on the site when the order is finalized according to the weight of the order.

4.2 The invoice corresponding to the customer's order is available on the site in his customer area via his order detail.

4.3 The invoice will be with Swiss VAT.

All prices are indicated subject to obvious typographical errors. If a manifest typographical error in the price should occur, KDC NUTRITION will inform the customer that the order will be invoiced at the rate corrected for the manifest typographical error.

The customer will have the possibility to accept the order under the corrected conditions or to cancel the order.

4.4 KDC NUTRITION reserves the right to modify the prices displayed on the site. The prices indicated online are subject to change at any time without notice.

However, the price modification cannot be taken into account on an order already validated by a customer. The prices in force at the time of validation of the order by the customer are valid.

Article 5: Terms of payment

Any purchase on the site is payable in cash and in full when ordering.

The choice of payment method occurs when the order is finalized.

The choice is made between:

- Bank cards : CB, VISA, MASTERCARD, AMERICAN EXPRESS

- STIPE payment Call Pay and Pay With Google

Due to a large number of Frauds related to Google Pay, the package will not be shipped until the funds are in our Stripe bank account.

Any bank charges claimed by the customer's bank remain at his expense.

The customer will credit the KDC account with the sum corresponding to the total amount to be paid, specifying the name and number of the order.

for any order in payment by bank transfer, the payment must reach us 48 hours maximum after the date of the order, after this period the order is canceled.

The shipment of the package will be effective ONLY when the full payment has reached us in our Credit Agricole bank account.

An order is only shipped after effective receipt of the full amount due.

The customer cannot claim any payment deadline without the express written consent of KDC NUTRITION in advance.

Article 6: Delivery of products

6.1 KDC NUTRITION strives to meet as soon as possible, depending on the reference logistical deadline in the profession, and to execute orders, except in cases of force majeure.

6.2 Delays in delivery cannot give rise to any penalty or compensation, nor to justify the cancellation of the order. The responsibility of the company can in no case be called into question for facts during transport, destruction, loss or theft.

6.3 Upon receipt of his order, in the event of an incomplete order or apparent defects, it is the customer's responsibility to make all the necessary reservations with the carrier. By signing the CNR or the carrier's voucher, the customer unreservedly accepts delivery and refrains from subsequently making a claim. It is the customer's responsibility to provide all the justifications as to the reality of the defects or missing items observed. No return can be made by the customer without the prior, express, written consent of the company. When after an inspection, an apparent defect or a missing one is noted, the customer can only ask the company for the replacement of the missing or defective products in an apparent way. The customer cannot therefore claim any compensation or the resolution of the order and cannot suspend payments for the products concerned.

Article 7: Guarantees and Liability

7.1 No action for non-compliance may be initiated by the customer more than fifteen (15) days after delivery of the products, even as a counterclaim in the context of an action brought against him by the company, for the recovery of debts. . Under the warranty against hidden defects, the company will only be required to replace defective goods free of charge, without the customer being able to claim damages, for any reason whatsoever. Defects and deterioration of the delivered products resulting from abnormal storage and / or conservation conditions at the customer's premises, in particular in the event of an accident of any kind whatsoever, cannot give rise to the guarantee owed by the company.

The guarantee only concerns hidden defects.

The customers being professionals, the hidden defect means a defect of realization of the product making it unfit for its use and not likely to be detected by the purchaser before its use, thus, a defect of design is not not a hidden defect. The warranty is limited to the replacement or repair of the defective product and does not cover damage and wear resulting from a special adaptation or assembly, abnormal or not, of the products.

7.2 KDC NUTRITION cannot be held liable in the event of force majeure.

7.3 The company declines any responsibility for the technical difficulties that the customers could meet on the site, whatever the cause, the origin, in particular in the case of occurrence of beug, of the non respect of the integrity of the information. through communication networks, lack of capacity of the terminal to restore information or transmission and routing within the normal deadlines of their orders.

7.4 The products sold on the site comply with the regulations in force in Switzerland. The responsibility of the company can not be engaged in the event of violation of the regulations of another country where the products would be delivered. Only the manufacturer undertakes to respect the dosages, ingredients.

Article 8: Customer service

Customer service is available to the CUSTOMER for any questions or information relating to our services, products or the follow-up of your order.

Article 9: Site protection

The site is the exclusive property of the company KDC NUTRITION.

Article 10: Applicable law

The GTC are governed by Swiss law.

In the absence of an amicable settlement, any person not respecting these stipulations will have to answer before the competent Swiss courts.
